What Kenyan law says about plant machinery safety

Plant and machinery safety in Kenya falls under the Occupational Safety and Health Act, 2007.

The Act requires occupiers to provide and maintain safe plant and systems of work and to provide appropriate information, instruction, training and supervision.

It also deals directly with fixed and mobile plant. Section 55 requires plant and machinery to:

  • be used for the work for which they were designed; and
  • be operated by a competent person.

The Act’s definition of a competent person takes into account adequate training, relevant qualifications and experience.

What that means for the operator

Know the machine. Understand the job. Do not improvise unsafe uses.

Workers also have responsibilities. They are expected to take reasonable care, use protective equipment provided, follow authorised safety instructions and report hazards they cannot safely correct.

Worksite safety is therefore shared—but the decisions made from the operator’s seat still matter greatly.

Worksite responsibility

A licence does not make every worksite safe

Holding the relevant licence or endorsement is important. It does not make every task automatically safe.

An operator may move from one site to another and find completely different conditions:

  • a deep excavation beside the route;
  • soft ground after rain;
  • delivery trucks crossing the working area;
  • overhead power lines;
  • pedestrians;
  • a different attachment; or
  • another machine working close by.

The operator still needs site induction, task instructions and an understanding of the hazards around that particular job.

Before starting

STOP → WALK → CHECK → LOOK → START

A useful pre-start habit can be remembered in five steps.

  1. STOP

    Understand the job before climbing into the cab. What are you doing, where are you moving, who is nearby and has anything changed?

  2. WALK

    Walk around the machine and immediate work area. Look underneath, behind, beside and at the ground.

  3. CHECK

    Look for anything that could affect safe operation: tyres or tracks, brakes, steering, leaks, hoses, attachments, mirrors, warning devices and safety equipment.

  4. LOOK

    Look beyond the machine. Where are the pedestrians, other machines, trenches, soft ground and overhead obstructions?

  5. START

    Begin work only when the machine, the work area and the intended movement are under control.

Before you sit

Use the steps and handholds

  • Keep them reasonably clean and free from mud or oil.
  • Where appropriate, maintain three points of contact.
  • Do not jump from the cab.
Once seated

Set yourself up before movement

  • Adjust the seat and mirrors where necessary.
  • Confirm visibility.
  • Use the seat belt or restraint system where provided.
  • Check the controls and make sure nobody has moved into the operating area.

Keep people outside the danger area

One of the strongest safety controls on any plant site is separation.

Do not assume people will move

A worker standing too close may be hidden, struck during reversing, caught by an attachment, trapped or exposed to falling material.

Blind spots

Never assume you have been seen

A person may be only a few metres away and still be invisible from the cab. If you cannot confirm a hidden area is clear, get assistance.

Banksman

Use a spotter when visibility is not enough

A competent banksman may be needed when reversing into a narrow area, working close to structures, positioning near an excavation or when part of the route is hidden.

Reversing

Know what is behind you

Check behind the machine, confirm the route, look for pedestrians, use mirrors and cameras where fitted, follow site procedure and use a banksman where necessary.

If the banksman disappears

Stop. Do not continue using the last signal. Re-establish contact, confirm the route and then move.

A good operator does not only know how to move the machine. They know when not to move it.

A plant machine should only carry people in positions designed and authorised for that purpose.

Slopes change how a machine behaves

Stability can change with gradient, direction of travel, attachment position, load, machine configuration, ground condition, speed and sudden steering. If the slope is doubtful, assess it before committing the machine.

Stay back from excavation edges

Heavy plant adds significant load close to an edge. Consider excavation depth, soil condition, rain, cracking, water, spoil placement, machine weight and the site’s established stand-off distance.

Ground

Never use the machine to test doubtful ground

Take extra care around recently backfilled areas, mud, waterlogged ground, soft shoulders, buried drains, underground chambers, loose fill and steep cross-falls.

Route

A pickup route may not be a plant route

A route that supports a pickup does not automatically support heavy plant. If the ground is doubtful, have it assessed.

Overhead

Look up before raising the machine

Check for electrical lines, communication lines, structures, temporary works and other overhead obstructions. If safe clearance cannot be confirmed, stop and get guidance.

Underground

Know what may be buried below

There may be electricity cables, water pipes, drainage, communication services, fuel lines or other buried infrastructure. If an unexpected service is exposed, stop digging and have it identified.

Keep attachments under control

Avoid unnecessary travel with attachments raised high. Follow the correct connection procedure and confirm that the attachment is secure.

Never rely on hydraulics as the only support

Nobody should place themselves beneath unsupported raised equipment. A hydraulic cylinder is not a safety stand.

  • Consider load weight and lifting radius where applicable.
  • Check lifting accessories, ground stability and communication.

  • Respect restrictions involving load and capacity.
  • Respect reach, attachments and slope limits.
  • Respect towing, payload and machine configuration.
  • The fact that a machine can perform a movement does not mean it is safe.

Site speed limits are maximums, not targets

Slow down around people, corners, reduced visibility, downhill travel, loads, uneven surfaces, excavations and other plant.

Use designated plant routes, one-way sections, pedestrian routes, crossings, loading zones, parking areas and entry/exit arrangements.

Another operator may have the same visibility problems you do. Do not enter another machine’s working area without coordination.

Weather

A safe route can change

  • Rain can reduce traction and soften excavation edges.
  • Rain can hide holes, fill depressions and weaken shoulders.
  • Dust can remove visibility.
  • Strong wind matters when raised loads or equipment are involved.
Fitness

A tired operator is still an unsafe operator

  • Do not operate while impaired by alcohol or drugs.
  • Fatigue matters.
  • Illness or medication can reduce alertness.
  • Being at work is not the same thing as being fit to operate.

End of task

Park as carefully as you operate

  • choose a safe location;
  • use stable ground;
  • lower the attachment;
  • place controls in the required safe position;
  • apply the parking brake;
  • shut down correctly; and
  • prevent unauthorised use.

Avoid parking where the machine blocks emergency access, traffic routes, pedestrian routes or another operator’s visibility. Do not leave it unnecessarily close to an unstable excavation edge.

  • hydraulic pressure;
  • electrical energy;
  • hot components;
  • raised equipment;
  • stored mechanical energy; or
  • parts capable of moving.
Emergency procedure

Know how to call for help

  • how to raise an alarm;
  • who to contact;
  • where first-aid facilities are;
  • who the designated first-aid personnel are;
  • the emergency access route; and
  • the site’s evacuation or assembly arrangements.

When should a plant operator stop work?

Knowing when not to move is part of competent operation.

  • somebody enters the danger area;
  • the banksman disappears;
  • instructions conflict;
  • visibility becomes inadequate;
  • the route is no longer clear;
  • the ground begins to fail;
  • an excavation edge shows movement;
  • a load becomes unstable;
  • an attachment is not secure;
  • steering or braking becomes unreliable;
  • a safety-critical fault develops;
  • an unexpected underground service is exposed;
  • overhead clearance cannot be confirmed; or
  • the proposed movement cannot be completed safely.

Safety is not a box ticked once at the beginning of the shift.

  • the machine is safely positioned;
  • the attachment is lowered;
  • the parking brake is applied;
  • controls are left safe;
  • shutdown is complete;
  • unauthorised use is prevented; and
  • defects have been reported.

There is no single distance suitable for every excavation. Safe stand-off depends on the excavation, ground, soil, depth, machine weight and site conditions. Use the distance established for that specific excavation rather than guessing.

Can workers stand beneath a suspended load?

Workers should be kept away from areas where suspended loads or raised equipment could fall, swing or move unexpectedly.

Why should an operator inspect the work area as well as the machine?

Because many serious plant hazards are outside the machine: workers, unstable ground, trenches, traffic, structures, services and other equipment.

Good plant operation is not measured only by how smoothly somebody digs, loads, grades, pushes or compacts.

Good operators understand what is happening around the machine.

Before moving, think about:

People. Machine. Ground. Route. Task.

If something is unclear, resolve it first.

Sometimes that takes ten seconds. Sometimes it means calling the banksman back. Sometimes it means checking the edge of a trench. Sometimes the correct decision is not to move at all.
